This Basic Assessment Report has been revised and is being made available for a 30-day commenting period to the registered I&APs and relevant Organs of State for their perusal and comment. The commenting period commences on 25 May 2021 and closes on 25 June 2021.

At the end of the commenting period, all comments will be captured and addressed and included in a Final Basic Assessment Report which will be submitted to the competent authority, DEA&DP, for the environmental decision.

The BAR is available for perusal at www.enviropart.co.za. Furthermore, a physical copy of the BAR is available for on-site reading at the Mfuleni Public Library for the duration of the commenting period.

INTRODUCTION

The City of Cape Town, the proponent, is the holder of an environmental authorisation for an integrated development on Erf 29654 (formerly Portion 2 of the remainder of Farm No. 451 and incorporating a Portion of Erf 1892) in Bardale, Blue Downs. The site is bound to the north by Fountain Village, to the west by Faure Klipfontein Road, and to the east by the Blue Downs Municipal Swimming Pool grounds (Please see Appendix A1: Locality Map).

The proponent has an approved Environmental Authorisation (EA) which was issued on
16 November 2010 (Ref. No. E12/2/3/1-A4/53-0988/10), amended on 30 October 2013 (Ref. No. 16/3/1/5/A4/5/1026/13), 03 November 2015 (Ref. No. 16/3/3/5/A4/5/3017/15) as well as on
22 July 2020 (Ref. No. 16/3/3/5/A4/5/3019/20). See Appendix E3: Existing approval(s) – Environmental Authorisations)

The EA authorises the construction of Single Residential 1 erven and Single Residential 2 erven, community facilities, public open spaces and two retention ponds. The affordable housing development on Erven 29654, herein referred to as ‘the site’, will be developed to make provision for adequate facilities and amenities to promote a conducive living environment and to enhance the lifestyle of the residents.

There are two wetlands located on the site, one in the northern portion of the site and the other towards the southern portion of the site. Both wetlands are fed by groundwater and are heavily degraded due to activities such as dumping, excavation, grazing and loss of almost all indigenous vegetation (Please see Appendix A2: Sensitivity map).

At the time of the previous basic assessment process, the two wetlands were not identified and, as such, not included in the Basic Assessment Report. The associated listed activity was not included in the application form to the Department of Environmental Affairs & Development Planning at the time and therefore has not been authorised.

This Basic Assessment Report is for the infilling or depositing of any material greater than 10 cubic metres into the two aforementioned wetlands (W1 and W2) which triggers Activity 19 of Listing Notice (GNR No. 983 of 2014) of the National Environmental Management: Environmental Impact Assessment (EIA) Regulations, as amended.

PROJECT PROPOSAL

The project proposal for this Basic Assessment Report entails infilling of wetlands W1 and W2. The infilling of the wetlands is for the development of stormwater ponds on the site as well hardening of the surrounding area. Infilling of the wetlands is in accordance with the approved layout for the housing development.

The site development plan has been updated slightly, including the following minor changes:

  • Access location switched for 2 of the cul de sacs for drainage purposes. This resulted in resizing / realignment of the existing erven;
  • Access granted to the services servitude from the internal road. Size of the CO1 property was increased; and
  • 5m pinch point close to London Way was expanded by removing an erf and accommodating it in the crescent.

The above changes did not result in any loss of erven nor in any other substantial changes in the site development plan. Please see the revised site development plan as Appendix B1(ii).

ALTERNATIVES

The EIA Regulations of 2014, as amended, require reasonable alternatives to the activity to be identified and assessed. Since the residential development has already been subjected to an EIA process and has been approved, there will be no alternatives to the layout. The layout has been approved and the site has been appropriately rezoned. The freshwater specialist recommends new stormwater management interventions to prevent impacts to the downstream (Kuils River) water resources due to the loss of two low-significance seasonal wetlands on-site and these have been included in the Environmental Management Programme to be implemented (See Appendix H: EMPr). Since the infilling of the wetlands will not undermine the approved development and would be suitable for development, alternatives will not be presented.

The two alternatives to be discussed in this Basic Assessment Report are thus Alternative 1 which entails the infilling of the two seasonal wetlands on the site to facilitate the implementation of the approved development and Alternative 2 which is the no-go alternative.

LEGISLATION

The 2014 NEMA Environmental Impact Assessment Regulations of 2014, as amended, apply to the proposed development and necessitate a Basic Assessment Process. The proposed development includes activities listed in GN983 of the 2014 EIA Regulations, as amended. This is:

The infilling or depositing of any material of more than 10 cubic metres into, or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock of more than 10 cubic metres from a watercourse.

IDENTIFIED POTENTIAL IMPACTS

The following impacts have been identified and assessed for Layout Alternatives 1 and 2, as well as the No-Go Alternative:

Planning and Design Phase

Loss of biodiversity associated with the loss of seasonal wetland habitat

Loss of approximately 0.6 ha of wetland habitat

Loss of the stormwater-related functions currently derived from the two seasonal wetlands on the site

Geotechnical impact of infilling the wetlands on the structures

Construction Phase

Increased runoff of sediments, cementitious waste and fuels/oils/other construction associated waste into the Kuils River system

Operational Phase

Water quality impacts in the Kuils River System

WAY FORWARD
